Incident Overview
The Stewards received a report from the Race Director (document 21) regarding an incident involving Car 27 (Nico Hulkenberg) during Practice 3. After hearing from the driver and team representative, and reviewing various data, the Stewards have made the following determination.
Key Details:
- No / Driver: 27 - Nico Hulkenberg
- Competitor: Stake F1 Team Kick Sauber
- Time of Incident: 13:33
- Session: Practice 3
- Fact: Car 27 overtook Car 44 under yellow flag conditions at 13:33.
- Infringement: Breach of Appendix H, Article 2.5.5 b) of the International Sporting Code.
Decision
No penalty is applied.
Reason for Decision
The Stewards carefully considered evidence including positioning/marshalling system data, video, timing, telemetry, and in-car video from Car 27's driver, Nico Hulkenberg, and the team representative.
Incident Sequence:
- Car 44 ran off track at Turn 1.
- A yellow flag was displayed at Turn 1 as Car 27 approached.
- After Turn 1, Car 27 overtook Car 44, which was significantly slower, before the green light panel between Turns 1 and 2. This occurred after the chequered flag had been displayed.
Driver's Explanation:
The driver of Car 27 stated that he did not see the yellow flag because it was displayed after he began turning into the apex of Turn 1. He also couldn't see the green panel due to Car 44 obstructing his view in front. Therefore, he was unaware he was in a yellow flag area until he passed Car 44.
Stewards' Conclusion:
Technically, this action constituted a breach of the regulations. However, considering the mitigating circumstances outlined by the driver, the Stewards decided not to apply a penalty.
Right of Appeal
Competitors are reminded of their right to appeal certain decisions of the Stewards, in accordance with Article 15 of the FIA International Sporting Code and Chapter 4 of the FIA Judicial and Rules, within the specified time limits.
